By Checking this box, you confirm that as a representative of your organization, you have read and understand the rules and regulations of the Pumpkins in the Park event.

In consideration of the acceptance of this application, the Applicant agrees to release and hold the City of Kirkland, Kirkland Downtown Association, Pumpkins in the Park and their directors, officers, agents, representatives, employees and volunteers harmless, and to promptly indemnify same from and against all claims, actions, and damages, liability of every type and nature, including all costs and legal expenses incurred by the applicant or any other party, by reason of any activity arising under or in connection with the Applicant's participation in the Pumpkins in the Park event, including loss of life, personal injury, and/or damage to property arising from or out of any occurrence, omission or activity relating to such participation. In the event the City of Kirkland, Kirkland Downtown Association, or Pumpkins in the Park shall be made a party to any litigation commenced by or against the Applicant, then the Applicant shall proceed and hold the City of Kirkland, Kirkland Downtown Association, and Pumpkins in the Park harmless and shall pay all costs, expenses, and reasonable attorney's fees incurred or paid by them in connection with such litigation. Furthermore, the Applicant agrees to pay all costs, expenses, and reasonable attorney's fees that may be incurred or paid by the City of Kirkland, Kirkland Downtown Association or Pumpkins in the Park in the enforcement of any of the covenants, provisions and agreements hereunder.
